In the first case to be heard in the federal courts in the Trump era, the Republican nominee has pleaded the Fifth Amendment in the face of accusations he lied to the FBI about contacts with Russia during the 2016 election.

Biden’s legal defense is asking the court to throw out the charges against him because of his Fifth Amendment privilege against self-incrimination.

The Fifth Amendment bars a president from “confidential communications” with the president or from “secret communication with the head of state of another state.”
